Treaty, withholding and PE planning under the India–UK DTAA.
Tax determines whether a British investment into India actually delivers its return. The India–United Kingdom DTAA allocates taxing rights on business profits, dividends, interest, royalties and fees for technical services and capital gains, and reduces Indian withholding where a valid tax residency certificate and Form 10F are in place. The benefit is now filtered through the Multilateral Instrument’s principal-purpose test and India’s General Anti-Avoidance Rules.
AMLEGALS positions the British structure for treaty access and permanent-establishment efficiency, advises on withholding on cross-border payments, and manages the capital-gains and repatriation position on exit. Where certainty matters we use Advance Pricing Agreements and the Mutual Agreement Procedure, and we defend the position in assessment and appeal if it is challenged.
Securing India–United Kingdom DTAA benefits with a valid tax residency certificate, Form 10F and substance aligned to the principal-purpose test.
Testing whether the British company’s India activity creates a permanent establishment and attributing profit if it does.
Advising on withholding on royalties, fees for technical services, interest and dividends paid to the British group.
Assessing the structure against the General Anti-Avoidance Rules and the Multilateral Instrument to confirm treaty benefits are sustainable.
Planning the capital-gains and indirect-transfer position so the eventual exit is efficient under the India–United Kingdom DTAA.
Using Advance Pricing Agreements and the Mutual Agreement Procedure, and defending assessments through appeal where required.
The treaty caps Indian withholding on dividends, interest, royalties and fees for technical services at agreed rates and allocates taxing rights on business profits and gains. To claim the benefit the British company must hold a valid tax residency certificate, file Form 10F and satisfy the principal-purpose test introduced by the Multilateral Instrument.
A permanent establishment can arise from a fixed place of business, a dependent agent who habitually concludes contracts, or, in some cases, a service presence or secondment. If a permanent establishment exists, India may tax the profits attributable to it. AMLEGALS reviews the India footprint and structures it to manage this risk.
Domestic rates apply unless reduced by the India–United Kingdom DTAA. Royalties and fees for technical services, interest and dividends each carry a treaty-capped rate available on production of a tax residency certificate and Form 10F. Where the payment is wrongly characterised, excess withholding or exposure can result, which careful contracting avoids.
Yes. An Advance Pricing Agreement provides certainty on transfer-pricing margins for up to five years (with rollback), and advance rulings and the Mutual Agreement Procedure address characterisation and double-taxation disputes. AMLEGALS advises when each mechanism is worth using for a British structure.
