GSTAT Delay Condonation Application and Evidence

Preparing the delay chronology, supporting records and application.

Strategic context

The issues that decide the outcome

A condonation application must explain the delay with evidence. It does not create an unlimited extension.

For taxpayer appeals, Section 112(6) allows a further three months after the Section 112(1) period on sufficient cause. First establish the underlying three-month deadline using communication of the order and any applicable government-notified filing date. A proposed filing outside the statutory extension cannot be treated as routinely condonable by the Tribunal.

Prepare a dated chronology with the order and service record, relevant filing directions, reasons for each material interval, supporting correspondence and any genuine medical or technical evidence. Match the explanation to contemporaneous documents; do not assert portal failure or illness without evidence.

The deliverables are a limitation note, verified chronology, draft application and affidavit where required, annexure index and response to objections. This page addresses application preparation; the linked limitation advisory page addresses whether the proposed appeal is within time.

Answers

Frequently asked questions

01Does Section 112(6) allow unlimited condonation?

No. For a taxpayer appeal it permits a further three months after the ordinary period on sufficient cause. Check transitional filing dates before calculating the period.

02Does a portal problem automatically excuse delay?

No. Preserve contemporaneous error messages, helpdesk records and attempted filing evidence. The Tribunal assesses sufficient cause; a generic allegation is not proof.

03What is the difference between the two delay pages?

The limitation advisory page addresses the applicable period and whether a route remains available. This page covers the application, chronology, evidence and response to objections needed when condonation is sought.
