An appeal to the Goods and Services Tax Appellate Tribunal generally arises from an appellate or revisional order under the GST framework. Businesses commonly approach counsel after an input tax credit demand, classification or valuation dispute, refund rejection, place-of-supply controversy, allegation of suppression, penalty order or an adverse first-appellate decision.
The first task is a maintainability and limitation review. The communication date, applicable notification, portal eligibility, pre-deposit position, relief sought and identity of the correct bench must be verified before drafting begins. A generic memorandum that merely repeats the reply to the show-cause notice usually leaves the central legal error unidentified.
