Projects listed in the Schedule to the EIA Notification, 2006 (as amended) require prior environmental clearance. These include mining, thermal power, airports, industrial estates, highways, ports, chemical manufacturing and certain construction projects based on area and investment thresholds.
The standard validity is 10 years for mining projects and construction projects, and 7 years for river valley projects. Other projects have validity periods specified in the clearance conditions. Extensions can be applied for before expiry.
Yes. NGT orders can be challenged before the Supreme Court of India within 90 days. The NGT has original jurisdiction in environmental matters and its orders are binding and enforceable as decrees of a civil court.
Yes, if the expansion exceeds the threshold limits specified in the EIA Notification or if the original EC conditions require it. The PARIVESH portal tracks all EC related applications and amendments online.
