The issues that decide the outcome
Data is the foundational input for AI systems, and the legal framework governing data acquisition, processing, storage, sharing and monetisation directly shapes AI capabilities and liabilities. The Digital Personal Data Protection Act 2023 (DPDPA) establishes the primary data-protection framework for personal data processing in India — requiring lawful basis (consent or legitimate use), purpose limitation, data minimisation, storage limitation, accuracy, data principal rights (access, correction, erasure, nomination, grievance redressal) and data fiduciary accountability. The DPDP Rules 2025 operationalise these obligations with specific requirements for consent managers, significant data fiduciaries, children’s data, cross-border transfer and breach notification. AMLEGALS advises AI companies on every aspect of data law as it applies to AI — from training-data acquisition and annotation through deployment and monetisation.
Beyond the DPDPA, AI data practices intersect with: copyright law (legality of scraping copyrighted works for training), database rights, the IT Act (intermediary liability for user-generated data), sector-specific data regulations (RBI data localisation, CDSCO clinical data requirements, IRDAI telematics guidelines), and cross-border data-transfer frameworks. Synthetic data, anonymisation techniques and federated learning create new legal questions about regulatory applicability and liability. AMLEGALS provides end-to-end data advisory for AI companies — data acquisition structuring, consent management, anonymisation assessment, data-sharing agreements, cross-border transfer compliance, breach-response planning and data-governance framework design.

Frequently asked questions
01What is a Data Fiduciary under DPDPA?
A Data Fiduciary is any person who alone or in conjunction with other persons determines the purpose and means of processing of personal data. AI companies that decide what personal data to collect, how to process it and for what purpose are Data Fiduciaries under the DPDPA and bear primary accountability for compliance.
02Can copyrighted works be used to train AI models in India?
The legality of using copyrighted works for AI training is unsettled in India. The Copyright Act 1957 does not have a specific text-and-data-mining exception. Fair dealing under Section 52 is narrowly defined. Risk assessment must consider the nature of the copyrighted works, the purpose of use, the proportion used and the economic impact on the rightsholder.
03What are cross-border data transfer rules under DPDPA?
The DPDPA permits transfer of personal data to countries notified by the Central Government. Transfer to non-notified countries is restricted. The Central Government may notify restricted jurisdictions where transfer is prohibited. AI companies must assess each data flow and ensure compliance with the applicable transfer framework.
04What is the penalty for data breach under DPDPA?
The Schedule to the DPDPA provides for penalties up to INR 250 crore for failure to take reasonable security safeguards to prevent a personal data breach, and up to INR 200 crore for failure to notify the Data Protection Board and affected Data Principals of a breach. The amount is determined by the Board after inquiry, having regard to the Section 33(2) factors, including the nature, gravity and duration of the breach, the type of personal data affected, its repetitive nature, any gain made or loss avoided, and the mitigation measures taken.
05Does an initial discussion create a lawyer-client relationship?
No. No engagement is treated as accepted until conflicts, scope and terms are confirmed in writing. An initial discussion is confidential and is used only to understand the matter and assess fit.
