Alternative remedy and the exceptions the courts have carved

The rule is discretionary, not jurisdictional. Which is why the pleading decides the outcome.

The short answer

The existence of an alternative statutory remedy is a self imposed restraint on the exercise of writ jurisdiction, not a bar on the power. The exceptions recognised in Whirlpool Corporation and applied in Radha Krishan Industries are breach of fundamental rights, violation of natural justice, want of jurisdiction, and a challenge to the vires of a provision. Courts have added, in tax matters, a challenge to a notification, inaction on a statutory application, and coercive recovery.

How to plead the exception

Name the exception. Do not leave the court to identify it. A single paragraph stating that the impugned order is without jurisdiction because the officer lacked competence, or because limitation had expired on the dates in the order itself, does more than ten pages of grievance.

Show why the appeal cannot cure it. Where a notification is challenged, the appellate authority cannot decide the vires. Where a hearing was denied, the appeal remedy involves the pre-deposit and delay while the recovery machinery runs.

Show the urgency, with figures. A frozen account, a stopped consignment, a deadline for a tender.

Where the appeal is available and adequate, consider filing it and seeking only interim protection from the writ court on a narrow point.

The patterns in GST writ practice

Natural justice petitions succeed most often, because the record either contains a hearing notice or it does not.

Limitation petitions succeed where the arithmetic is on the face of the order, and are refused where they require an examination of extension notifications and exclusions.

Vires petitions are entertained but are usually tagged with batches and take time; interim protection is the practical relief.

Blocking and attachment petitions succeed frequently because there is no appellate remedy and the harm is immediate.

Classification and valuation petitions are almost always sent to the appellate authority.
